Seed Care & Germination

Grass seed is a live, natural product and depends on proper, consistent watering for successful germination. Evergreen Lawn Aeration is not responsible for weed presence, weed competition, or the elimination of pre-existing weeds.

Limits of Liability

Evergreen Lawn Aeration cannot be held responsible for conditions or outcomes outside of our control, including but not limited to:

  • Application of herbicides within three (3) months following service

  • Improper or incorrect herbicide use

  • Excessive fertilization or insufficient watering

  • Damage caused by animals or vandalism

  • Adverse weather events such as heavy rain, snow, heat, or drought

  • Damage resulting from lawn use before full establishment

Overseeding Outcomes

Although we perform overseeding and lawn services using industry best practices, results cannot be guaranteed. Grass establishment is influenced by variables such as soil health, weather patterns, and ongoing maintenance performed by the property owner.

 

Property Marking & Damage Avoidance

Evergreen Lawn Aeration is not responsible for damage to items that are not clearly or correctly marked prior to service. Property owners are responsible for identifying the location of:

  • Sprinkler heads

  • Shallow pipes or utility lines

  • Invisible pet containment systems

  • Any additional lawn features or fixtures that could be affected during service

Safety Advisory

For safety reasons, treated areas should not be used until new grass is established and any applied fertilizers have fully absorbed. Evergreen Lawn Aeration is not liable for injuries resulting from premature access to serviced areas.

 

Protection of Property & Equipment

We are not responsible for damage to vehicles, structures, or equipment located near the service area. Please remove vehicles from the work zone and notify us in advance of any sensitive or restricted areas that may require special consideration.

 

Clean-Up & Weather Impact

Lawn treatments, particularly during wet or muddy conditions, may result in residual soil or debris. While we make every effort to leave the area tidy, some remaining dirt or mud may be unavoidable during or following rainy conditions.

 

Cancellation, Weather & No-Show Policy

By accepting an estimate and scheduling service, the customer expressly agrees to the terms of this policy.

 

Cancellations & Rescheduling

Cancellations or rescheduling requests made within seventy-two (72) hours of the scheduled service date will result in a cancellation fee equal to fifty percent (50%) of the quoted price, representing a reasonable estimate of scheduling, labor, and preparation costs incurred.

Cancellations made more than seventy-two (72) hours in advance are not subject to a fee.

 

Weather Policy

Lawn services are performed rain or shine. Weather conditions, including forecasted or actual rain, do not waive this policy.
Customer-initiated cancellations or rescheduling due to weather within seventy-two (72) hours of the scheduled service date remain subject to the 50% cancellation fee.

Evergreen Lawn Aeration retains sole discretion to postpone or reschedule services due to unsafe or unsuitable conditions. If Evergreen Lawn Aeration elects to reschedule due to weather, no cancellation fee will apply.

 

No-Show Policy

If Evergreen Lawn Aeration arrives as scheduled and is unable to perform services due to customer absence (unless prior approval to work while absent has been granted), lack of access, unmarked hazards, or failure to properly prepare the property, the appointment will be deemed a no-show, and a fee of fifty percent (50%) of the quoted price will be charged.

 

Payment Terms, Late Fees & Prepayment Policy

Payment is due upon receipt of invoice unless otherwise agreed to in writing.

 

Any invoice balance not paid within twenty (20) days of the invoice date will be considered past due and may be subject to a late fee of up to 1.5% per month (18% annually) or the maximum rate permitted under Washington law, whichever is less.

 

Late fees represent a reasonable estimate of administrative and collection costs. Evergreen Lawn Aeration reserves the right to suspend services until all outstanding balances are paid in full.

 

Prepayment Requirement: Customers with a history of late or non-payment may, at Evergreen Lawn Aeration’s discretion, be required to prepay in full for future services prior to scheduling or service delivery.

 

Customer is responsible for all reasonable costs of collection, including administrative fees, collection agency fees, and attorney’s fees, to the extent permitted by Washington law.
